1. Who Is Responsible for Your Data

The controller for the purposes of this policy is Monaco Lux Yachts, the brand under which monacoluxyachts.com operates from Monaco. All questions about this policy, or about how we handle a particular person's data, should be sent to [email protected]. We do not publish a separate company registration number, VAT number or office address on this site, and this policy does not state one.

2. Data We Collect and Where It Comes From

When you use our enquiry form, we collect the name, email address, phone number (if you choose to give it), the yacht you are interested in (if selected), your proposed charter start and end dates, the number of guests, and any message you write. The form also sends the page you were on and the website that referred you, so we understand which enquiry belongs to which conversation.

If you contact us by email, phone or WhatsApp instead, we collect whatever you tell us through that channel. When you tap a WhatsApp button on the site, we record the click itself — the page URL, the referring website, the language of the page and the prefilled message text — before WhatsApp opens; the conversation that follows takes place on WhatsApp and is governed by Meta's own privacy policy, not by this one.

Our server also logs technical information for every visit, such as the browser type, operating system, device type, screen size and the page requested, together with the time of the request, for the short period needed to keep the site secure.

3. Why We Use Your Data

We use enquiry and contact data to take the pre-contractual steps you ask for — preparing and sending a written quote for a day charter or a longer charter — and, once a booking is confirmed in writing, to perform that contract: arranging the yacht, the crew and the logistics of your charter. Keeping server logs and recording WhatsApp clicks rests on our legitimate interest in keeping the site secure and understanding which enquiry channel is working, an interest that does not override your own rights when the data involved is this limited. Where a confirmed booking must be recorded for tax or accounting purposes, we process it to comply with that legal obligation.

We do not use personal data for automated decision-making, we do not sell it, and we do not send marketing communications unless you have asked us to.

4. Who Receives Your Data

Enquiries reach our own team through an internal messaging tool, used only so that we can reply to you quickly; they are stored in our own booking system. When a charter is confirmed, the captain or driver who will actually operate your yacht or boat receives the information needed to carry out the service — typically the date, the number of guests and any special requests.

For a confirmed charter, we may also need the full names of all guests on board, because Monaco's port authorities require an accurate crew and passenger list before departure; we collect and pass on only what is needed for that purpose.

The static website itself is kept online by a hosting provider, which processes server logs on our behalf. Web fonts are served by Google Fonts, which receives the visitor's IP address when a page loads, and the phone-number field in our enquiry form uses the intl-tel-input library delivered through the jsDelivr content-delivery network; neither of these sets cookies for us. If you start a conversation with us on WhatsApp, that conversation is also received by WhatsApp (Meta) as the operator of that messaging service.

5. Transfers Outside Monaco

Monaco Lux Yachts is based in Monaco and your enquiry and booking data is handled from here. Where a service we rely on operates internationally — such as Google Fonts, the jsDelivr content-delivery network, or WhatsApp when you choose to write to us there — your data may be processed outside Monaco as part of that service's own infrastructure, under that service's own safeguards and privacy terms.

6. How Long We Keep Data

If an enquiry does not lead to a confirmed booking, we delete it twelve months after it was made. If it leads to a confirmed charter, we keep the related booking records for as long as Monaco's tax and accounting rules require us to. Server logs kept for security purposes are retained only for a short period before being overwritten. Local- and session-storage entries used on the site either expire automatically — the visit-measurement identifier after thirty days of inactivity, the yacht-selection entry when the tab is closed or the form is submitted — or can be cleared by you in your browser at any time; none of them contains your name, email or phone number.

7. Keeping Your Data Secure

Enquiry and booking data is held in our booking system and accessed only by the people who need it to answer you or to run your charter. Server logs and other technical safeguards help us detect and respond to unusual or malicious activity on the site. The website itself does not set cookies and does not install third-party analytics, advertising or social-media trackers; the only measurement in place is our own script, served from our own domain, which we describe in the next section for completeness.

8. Visit Measurement Without Cookies

monacoluxyachts.com counts visits using its own script rather than a third-party analytics tool. It records the pages you viewed, time spent on each page, the referring website, any campaign parameters carried in the link such as UTM or ad click identifiers, your device type, browser, operating system, screen size and browser language, and the country derived from your IP address — the IP address itself is not stored. If you send an enquiry or tap a WhatsApp or phone link, that action is linked to the same visit so we can see which channel led to it. A random visitor and session identifier used for this measurement is stored in your browser's local storage for up to thirty days and can be deleted at any time; a separate local-storage entry simply remembers that you have closed the cookie notice.

9. Your Rights, Complaints, Children and Changes

Under Monaco Law No. 1.565 of 3 December 2024 on the protection of personal data, and under the EU General Data Protection Regulation if you are visiting us from the European Union, you have the right to access the personal data we hold about you, to have it corrected or deleted, to restrict or object to certain processing, and to receive a copy in a portable format where that right applies. To exercise any of these rights, write to [email protected]; we may ask you to confirm your identity before acting on the request, and we respond within one month. If you believe your rights have not been respected, you may lodge a complaint with the Autorité de Protection des Données Personnelles (APDP) in Monaco.

Our services are intended for adults arranging a yacht charter, and we do not knowingly collect personal data from children. We may update this policy as our site or our practices evolve; the version published on monacoluxyachts.com is the one that applies, and we encourage you to check it before sending us your data.
