Terms and Conditions – Monaco Lux Yachts Charter Bookings

Monaco Lux Yachts presents a fleet of around 100 yachts and boats — superyachts, yachts, sport-yachts, day-boats and catamarans — available for crewed day charters and longer charters in and around Monaco, with day rates starting from €1,700. We act as the charter organiser presenting these vessels and arranging bookings on behalf of clients.

These Terms and Conditions apply to every charter booked through monacoluxyachts.com, by email, by telephone or by WhatsApp, regardless of the yacht chosen or the length of the charter. They do not apply to the use of the website itself for browsing purposes, which is addressed separately in the section on website use and content below.

No charter is paid for or confirmed directly on the website. A client interested in a yacht sends an enquiry through the online form, or contacts us by email, telephone or WhatsApp, indicating the desired yacht if known, the charter start and end dates and the number of guests.

Once an enquiry is received, our team reviews availability and replies with a written quote setting out the yacht, dates, charter fee and any extras identified at that stage. A booking only becomes binding once the client has accepted the written quote and Monaco Lux Yachts has confirmed the booking in writing. No verbal exchange, availability check or provisional hold constitutes a confirmed booking until this written confirmation has been issued.

The charter fee quoted in writing covers the yacht and its crew for the agreed duration, as described in that quote. Published day rates starting from €1,700 are indicative of the range offered on the fleet and are always superseded by the specific written quote issued for a given yacht and date.

Fuel, marina and port fees, the advance provisioning allowance (APA) applicable to larger yachts, catering and any other extras are charged only when they are expressly stated in the written quote. Nothing is added to the charter fee beyond what has been quoted in writing, and any additional service requested after confirmation will be quoted separately before it is provided.

A booking is confirmed once a deposit equal to 40% of the charter fee has been paid. The balance of the charter fee is due 10 days before the departure date. Payment instructions, including the method accepted for a given booking, are communicated directly by our team in the written quote and confirmation.

Failure to pay the balance by the due date may result in the booking being treated as cancelled by the client, in which case the cancellation terms set out below apply.

Monaco Lux Yachts offers a voluntary cancellation policy, described here in full; Monegasque consumer law applies to the charter relationship, and this policy is not a statutory right of withdrawal. Cancellation must be sent in writing by email to [email protected], and the date on which that email is received by us is the date used to determine which cancellation tier applies.

Where cancellation is received more than 21 days before departure, the deposit already paid is refunded in full. Where cancellation is received between 10 and 21 days before departure, the deposit is retained by Monaco Lux Yachts and the remaining balance is not due. Where cancellation is received less than 10 days before departure, the full charter fee becomes due regardless of whether it has already been paid in full.

Requests to change the charter date or yacht are treated, where possible, as an amendment rather than a cancellation, subject to availability and written confirmation; where no alternative can be arranged within the required timeframe, the cancellation terms above apply to the original booking.

If the captain or the relevant port authority considers that weather, sea conditions or any other circumstance make departure or the planned itinerary unsafe, the client is offered a choice between a free new date for the charter and a full refund of all sums paid. The captain's assessment of safety is final and is not open to challenge once made.

The same choice between a new date and a full refund applies where a charter cannot proceed because of a technical issue affecting the yacht, or because of an event of force majeure beyond the reasonable control of Monaco Lux Yachts, such as a port closure, official prohibition on navigation, or a comparable event. In every such case, Monaco Lux Yachts bears no further liability beyond this choice of rebooking or refund.

The number of guests on board may never exceed the licensed capacity of the chartered vessel, as communicated at the time of booking confirmation. The crew may refuse boarding to any guest whose number exceeds that capacity or whose presence or conduct would endanger the safety of persons on board.

Clients are responsible for communicating the correct number of guests at the time of enquiry and for ensuring that this number is respected on the day of departure. Any change in guest numbers must be notified to our team in advance and is subject to the vessel's licensed capacity being observed.

The captain has full authority over the vessel, its crew and all matters of navigation and safety at all times during the charter. Instructions given by the captain for the safety of persons or the vessel must be followed by all guests without exception.

The itinerary agreed at the time of booking is indicative and may be adjusted by the captain where weather, sea state, port restrictions or safety considerations require it. Monaco Lux Yachts will always seek to keep as close as possible to the client's preferences, but the captain's decision on any change to the planned route or schedule is final.

Guests are expected to behave in a manner that respects the safety of the vessel, the crew and other guests on board. The crew may end a day's charter early, without compensation, where the conduct of a guest puts the vessel, its occupants or the charter itself at risk.

The client is responsible for any damage caused to the yacht, its equipment or its tenders by guests during the charter, beyond ordinary wear consistent with normal use, and such damage will be charged in addition to the charter fee. Guests are responsible for their own personal belongings brought on board; Monaco Lux Yachts and the crew are not responsible for items lost, damaged or left on the yacht at the end of a charter.

Monaco Lux Yachts arranges the charter and relies on the professionalism of the crew operating each vessel, but cannot be held liable for events beyond its reasonable control, including weather, sea conditions, mechanical failure acting as described above, or the acts of third parties such as port authorities.

Where Monaco Lux Yachts is found liable for a failure directly attributable to the organisation of the charter, that liability is limited to the charter fee paid for the booking concerned. Nothing in these Terms and Conditions excludes liability for death or personal injury caused by proven negligence.

Any complaint relating to a charter should be sent to [email protected] as soon as possible after the event giving rise to it, with a clear description of the booking concerned and the issue encountered. We review every complaint against the written quote, confirmation and the circumstances reported by the crew, and respond directly to the client once that review is complete.

The content of monacoluxyachts.com, including yacht descriptions, photographs, rates and fleet information, is provided to help clients choose a suitable charter and request a quote. It may not be copied, reproduced or reused for commercial purposes without our written consent.

The enquiry form on the site collects the visitor's name, email, optional phone number, chosen yacht if any, charter dates, number of guests and any message provided, together with the page visited, so that we can respond accurately. Use of the website is also subject to the separate privacy notice published on the site.

These Terms and Conditions are governed by the law of Monaco. Any dispute arising from a booking made through monacoluxyachts.com that cannot be resolved directly with Monaco Lux Yachts falls under the exclusive jurisdiction of the courts of Monaco.

Monaco Lux Yachts may update these Terms and Conditions from time to time to reflect changes in its services; the version published on monacoluxyachts.com at the time a written quote is issued is the version that applies to that booking.
